 In this case, a legal gap in the Bahawalpur adaptation of the Punjab Land Revenue Act was highlighted, as it did not empower the Commissioner to pass orders in cases he himself called for. The Commissioner’s order quashing a Tahsildar’s warrant of arrest was therefore invalid, but the Board of Revenue upheld the substance of that decision under its revisional powers. It was clarified that the respondent, being a commission agent and not a defaulter, could not be subjected to coercive recovery measures, and the Tahsildar’s arrest order was rightly quashed.
