Law: Constitution of Pakistan, 1973
Section: 199,25,10-A,212(2)
Summary:
The petitioners, Sub-Engineers (BPS-11) with around 30 years of service in the Education Works/Education & Literacy Department, Sindh, sought Time Scale Promotion (TSP) due to severe career stagnation and discriminatory treatment compared to teaching and other cadres who were granted higher pay scales without regular promotion. They argued violation of equality and fair-trial rights. The respondents opposed on grounds of maintainability, availability of promotion avenues, and jurisdiction of the Service Tribunal.
The Court held that Time Scale Promotion is a policy-based financial incentive, not a regular promotion or change in post, meant to address stagnation. Relying on Supreme Court precedents, the Court disposed of the petition by directing the respondents to consider the petitioners’ case in light of the settled principles, to be completed within three months, without costs.
