Summary
The High Court dismissed the constitutional petition and upheld the imposition of fine (as reduced by the appellate court) against the petitioners for indulging in quackery under the Punjab Healthcare Commission Act, 2010. The Court held that the Hearing Committee, constituted under the Punjab Healthcare Commission Regulations, 2016, is a valid competent authority empowered to exercise the Commission’s statutory powers, including imposition of fines under Section 28 of the Act. It was further held that factual determinations regarding quackery, arrived at after due process, are not open to interference in constitutional jurisdiction.
