Advocate Ashfaque Ali Panhwar V/S. Fed. Of Pakistan

Law: Constitution of Pakistan, 1973

Section: 10-A,17,18

Summary:
The petitioner, an advocate, challenged a resolution passed by the Karachi Bar Association (KBA) that restricted lawyers from representing clients in cases involving other KBA members. He argued that due to this resolution, he was pressured to withdraw from a bail application, violating his client’s constitutional rights. The President of KBA admitted before the Court that the resolution dated 12-03-2024 was unconstitutional. The Court held that the KBA cannot restrict its members from appearing in such cases, as it violates fundamental rights guaranteed by the Constitution. The petition was disposed of after KBA undertook to withdraw the resolution and ensure no harassment of lawyers.
