Case Summary
The revision petition challenged concurrent judgments whereby the respondent’s suit for pre-emption under the Punjab Pre-emption Act, 1991 was decreed. The petitioners contended that the respondent failed to strictly comply with the mandatory requirements of talb-i-muwathibat and talb-i-ishhad, asserting that registration of the sale deed amounted to constructive notice, that notices were defectively served, that contradictions existed in the prosecution witnesses’ testimony, and that partial pre-emption was impermissible.
The High Court rejected all objections, holding that registration of a sale deed does not constitute deemed knowledge for purposes of talb-i-muwathibat, that refusal to accept notices constitutes valid service, that photocopies of notices bearing original signatures are legally valid, and that minor inconsistencies in testimony do not defeat a duly proven statutory chain of pre-emption. The revision petition was dismissed with costs.
