Law: Cantonments Rent Restriction Act, 1963

Section: 17(8),17(9)

Summary

The appeal under section 24 of the Cantonment Rent Restriction Act, 1963 was filed against an eviction order passed by the Additional Rent Controller, Lahore Cantt. The eviction was ordered due to the tenant’s non-compliance with a tentative rent deposit order passed under section 17(8) of the Act. The tenant failed to deposit arrears of rent within the prescribed time and also failed to deposit rent for December 2023. The appellate court held that the provisions of section 17(9) are mandatory in nature, leaving no discretion with the Rent Controller to condone even a one-day delay. Consequently, the appeal was dismissed and the eviction order was upheld.
