Case Summary
The applicant sought post-arrest bail in a case involving alleged cyber-blasphemy and abetment under PECA 2016 read with various blasphemy provisions of the PPC. The bail plea had earlier been declined by the Sessions Court. The applicant argued false implication, mala fide intent, misuse of social media accounts, lack of conclusive forensic linkage, and relied upon precedents where bail was granted in similar circumstances.
The Court observed that while blasphemy allegations are serious, such cases are also prone to misuse through hacking and false digital evidence. The prosecution’s case was primarily documentary and forensic in nature, the probative value of which required determination at trial. The investigation did not conclusively establish whether the applicant created or merely forwarded the alleged content. Since the challan had been submitted, evidence was yet to be tested, and the matter required further inquiry, continued incarceration was not justified. Consequently, post-arrest bail was granted on surety.
