(a) Admiralty Jurisdiction of High Courts Ordinance (XLII of 1980)--

3(2)(H) --- Admiralty jurisdiction --- Expression "arising out of' agreement relating to carriage of goods as used in para (H) of S.3(2), Admiralty Jurisdiction of High Courts Ordinance, 1980, whether equivalent of expression "connected with"---Effect.

Expression "arising out or' in paragraph (H) of subsection (2) of section 3 of, Ordinance (XLII of 1980) is the equivalent of the expression connected with" and a claim, whether founded in contract or tort, notwithstanding that there was no contract directly between the parties to an action, would fa l within the Admiralty jurisdiction provided that it arose out of, in the! sense of being connected with, an agreement of the kinds specified in paragraph (H) Viz. an agreement relating to the carriage of goods in a ship or to the use or hire of a ship.
