Law: Karachi Port Trust Act, 1886

Section: 17(3), 24(ii)

Summary of the Case:
The petitioner, a BPS-19 officer at Karachi Port Trust (KPT), challenged her transfer and re-designation through letters dated 23.1.2023 and 13.6.2023, arguing that she was unlawfully removed from the post of Dy.CMO-1 (Admin) and replaced by a junior officer, while her confirmation as SMO-Clinical was retrospective and invalid.

The petitioner contended:

The Board Resolution No.334 (BR 334) delegating authority to the Chairman to re-designate and transfer posts up to BPS-19 was ultra vires, as Section 17(3) of the KPT Act 1886 allows delegation only to committees, not individuals.
