Summary:
The appellants were convicted by the Anti-Terrorism Court for kidnapping for ransom under Section 365-A PPC and provisions of the Anti-Terrorism Act, 1997. The prosecution case relied on delayed FIRs, identification parades, and statements of witnesses. Upon appeal, the Court found significant procedural lapses: delayed and flawed FIR and identification parades, discrepancies in witness testimonies, lack of recovery evidence, and failure to properly identify the accused. Due to these inconsistencies and doubts regarding the prosecution’s case, all appellants were acquitted and released.
