Section: 4,25

Summary:

The petitioners, Private Secretaries promoted to BS-17, challenged their exclusion from promotions to Section Officer/Assistant Commissioner under Sindh Civil Servants rules. They claimed violations of the Sindh Civil Servants (Appointment, Promotion & Transfer) Rules, 1974, and sought promotion along with consequential benefits. The Court noted that PMS Rules 2018 were declared ultra vires by the High Court, with appeals pending in the Supreme Court. The petitioners’ promotions should follow pre-2018 rules, considering seniority and vacancies. The Court disposed of the petition, directing the department to act according to existing laws and rules until the Supreme Court decides.
