Law: Standing Orders Ordinance, 1968
Section: 12(3)
Summary:
The case involves petitioners who were verbally terminated from their employment in the Weaving Department of a company on 17.06.1999. They filed grievances and approached the Labour Court after their grievances were ignored. The Labour Court awarded them back benefits from 17.06.1999 to 03.12.2005 and 15 months’ salary as compensation. On appeal, the Appellate Tribunal overturned part of the Labour Court’s order and increased compensation to 30 months, without properly considering the evidence. The High Court reviewed the matter, found the Labour Court’s findings on back benefits valid, and restored the back benefits award while nullifying the compensation enhancement. Service dues were directed to be paid based on length of service.
