Summary

The petitioner, a retired Civil Aviation Authority employee, claimed that being illiterate, he was deceived into signing pension documents opting for full commutation of pension (third option), thereby losing entitlement to medical and hospitalization benefits. He sought reversal of this option after receiving the commuted amount. The respondent authority denied deception, asserting that the petitioner voluntarily opted, received payment, and executed a full and final settlement undertaking.

The Court held that the petition was filed after an unexplained delay of eight years, attracting the doctrine of laches, and that the allegations of deception raised disputed questions of fact not maintainable under constitutional (writ) jurisdiction. Having accepted the benefits, the petitioner could not resile from his choice. Consequently, the petition was dismissed.
