Law: Sindh Co-operative Societies Act (XXVIII of 2020)

Section: 73,116,117,53(2)

Law: Code Of Civil Procedure, 1908.

Section: ORDER VII,9

Summary:
The High Court allowed the appeals and set aside the orders returning the plaints, holding that civil disputes “touching the business of a cooperative society” fall within the exclusive jurisdiction of the Special Court for Co-operative Societies under the Sindh Co-operative Societies Act, 2020. The trial court erred by relying on a Single Judge order while ignoring binding Division Bench and Supreme Court precedents. The suits were remanded to the Special Court for fresh decision on merits.
