SUMMARY OF THE JUDGMENT

This writ petition challenged the judgment and decree dated 14.05.2025 passed by the Additional District Judge, Layyah, whereby the revision petition of respondent No.12 was accepted and the petitioner’s plaint was rejected under Order VII Rule 11 CPC, treating the civil suit as barred under Section 43 of the Benami Transactions (Prohibition) Act, 2017.

Background

  • The petitioner (husband) filed a suit seeking declaration and mandatory injunction, asserting that a property purchased from his income was transferred in his wife’s name as a benami / trust arrangement because he was a government servant.
  • The wife denied the claim and sought rejection of the plaint under Order VII Rule 11 CPC, arguing that the suit was barred under Section 43 of the Benami Act.
  • The trial court dismissed the application, but the appellate court (ADJ) reversed it in revision and rejected the plaint.

Core Legal Issue

Whether Section 43 of the Benami Act bars Civil Court jurisdiction in private disputes between individuals where no proceedings under the Act have been initiated.

Court’s Analysis

  • Benami Act is aimed at transactions intended for concealment and illicit purposes, policed through a statutory framework of authorities and tribunals.
  • Section 43 is an ouster clause, and ouster of jurisdiction under Section 9 CPC must be strictly construed.
  • Section 2(8)(A)(b)(ii) creates a statutory exemption for properties purchased in the name of a spouse or children from the known income of the purchaser—such transactions are not benami within the meaning of the Act.
  • Section 43 applies only when authorities under the Benami Act are seized of proceedings. In the present case, no such proceedings have been initiated.
  • The dispute between husband and wife over ownership, fiduciary relationship and intention is a civil matter requiring evidence, not within the exclusive domain of Benami authorities.
  • The appellate court erred in treating mere reference to “benami” as a bar to civil jurisdiction.
  • Reliance placed on 2022 CLC 1196 and 2022 CLC 492, holding that civil jurisdiction is excluded only when proceedings under the Act are invoked and the transaction falls within the statutory definition without falling into the exemptions.

Final Decision

  • The writ petition is allowed.
  • The impugned judgment dated 14.05.2025 is set aside.
  • The trial court is directed to proceed with the suit on merits, uninfluenced by earlier observations.

🏷 TAG LINE

Benami Act’s jurisdictional bar does not apply to exempt spousal transactions or civil disputes where no proceedings under the Act exist.
