Law: Constitution of Pakistan, 1973
Section: 199
Summary:
The petitioners, employees of the Intellectual Property Organization (IPO), sought retroactive seniority from their initial contract appointment in 2009 and promotions under the IPO (Services) Rules, 2022. The Court held that contractual/ad-hoc service cannot be counted for seniority or promotion; seniority starts from the date of regularization in 2012. Promotions are subject to eligibility, fitness, and rules. The Court directed the competent authority to consider the petitioners for promotion on a seniority-cum-fitness basis with their batchmates, subject to vacancies, within two months. The petition was otherwise dismissed under Article 199.
