Summary:
The petitioner, a retired Director General of Sindh Building Control Authority and a Stage IV cancer patient, was placed on the Passport Control List (PCL) by NAB while facing trial in Reference No.01/2025. He sought permission to travel abroad for urgent medical treatment in Canada. The petitioner argued that his fundamental rights under Articles 9 (Right to Life), 15 (Freedom of Movement), and 25 (Equality) were being violated. The court found that a pending criminal case does not indefinitely override fundamental rights, especially where life-threatening medical treatment is required. The Court set aside the impugned orders and letters, ordered removal of the petitioner’s name from PCL, ECL, and Blacklist, and allowed him to travel abroad for three months, subject to furnishing security.
