Khaliq Islam Qureshi and Others V/S NBP and Others Sindh High Court, Karachi

Law: Constitution of Pakistan, 1973

Section: 4, 5, 8, 9, 14, 25, 199

Summary:
The petitioners, employees of the National Bank of Pakistan (NBP), challenged the bank’s discriminatory treatment between Management Trainee Officers (MTOs) and non-MTOs regarding pay, promotions, and benefits. Despite Supreme Court rulings (Civil Appeal No. 1644/2013 and Civil Petitions Nos. 4337–4339/2019) declaring such distinctions unconstitutional and directing equal treatment with retrospective effect, NBP introduced Compromise Agreements in 2020 coercing non-MTO employees to waive their rights. The Court held that NBP, as a statutory body, is amenable to constitutional jurisdiction under Article 199. Agreements obtained under coercion or to frustrate Supreme Court orders are void. The Court directed immediate equalization of pay, perks, promotions, and benefits for all similarly placed employees, dismissing the bank’s defenses based on estoppel or approbate-reprobate doctrine.
