1. Case Overview
- Three connected writ petitions (W.P. No. 373/1981, 4486/1981 & 4487/1981) were decided through this single judgment by the Lahore High Court. All petitions challenged various orders of the Land Reforms Authorities, beginning from 1972 up to 1980, which had declared Gift Mutations No. 105 (dated 29.08.1970) and 147 (dated 28.11.1970) as void for purposes of MLR-115 (Land Reforms Regulation, 1972).
- Petitioners claimed that the gifts were protected under Explanation II to Paragraph 7(b) of MLR-115 and the Notification dated 23.01.1974, and further argued that proceedings had abated under the Qazalbash Waqf (PLD 1990 SC 99) judgment.
2. Key Facts
