Facts
The appellant, Syed Mudassar Shah, was prosecuted under Section 9(c) of the Control of Narcotic Substances Act, 1997 in F.I.R. No. 89 dated 17.12.2008, registered at Police Station ANF, Rawalpindi.
According to the prosecution, upon receiving secret information, ANF officials led by S.I. Waqar Ahmad (PW-2) and Major Fayyaz Hussain (D.D. Incharge) intercepted a white Suzuki Mehran at the Islamabad Motorway Toll Plaza.
On search, 69 packets of charas, 2 packets of opium, and 1 packet of heroin were recovered from beneath the CNG cylinder.
