(Farrukh Imran & others v/s Federation of Pakistan & others )
Law: Constitution of Pakistan, 1973
Section: 187(2),199,9,25
ummary:
Former contractual employees of Pakistan State Oil (PSO) filed a petition seeking enforcement of their salary, pension, and long-term service benefits from their original hiring dates, as recognized by earlier Sindh High Court and Supreme Court decisions. They alleged that after regularization in 2019, PSO reduced their basic pay, introduced a “Regularization Allowance†to avoid full benefits, and denied increments, provident fund contributions, and medical/pension rights equivalent to permanent employees.
PSO argued the petition was not maintainable under Article 199, as it is a company governed by master–servant law, not a federal entity, and claimed full compliance with the Supreme Court’s 2018 order (2018 SCMR 1181). The Court observed that the Supreme Court had accepted PSO’s compliance but allowed employees to challenge salary calculations before appropriate authorities. The Sindh High Court thus disposed of the petition, directing PSO to decide the employees’ cases within three months, and if dissatisfied, the petitioners may pursue further legal remedies.
