Summary:
Two accused, Ramzan Ali and Saqib, were arrested for preparing and possessing narcotics — 450g methamphetamine (“Iceâ€), 1000g crush heroin, and 950g heroin powder. They sought bail citing delayed FIR, health issues, and doubtful recovery. The Court rejected the bail applications, holding that the quantity of drugs placed the case under the prohibitory clause of Section 497(1) Cr.P.C. The Court ruled that the medical plea was unsubstantiated, no mala fide was alleged, and recovery was corroborated by official presumption under Article 129(e) QSO. The Court cautioned the defense counsel for procedural impropriety in filing successive bail applications and directed the trial court to conclude proceedings within 60 days under Article 10-A of the Constitution.
