[Mansoor Umar Khanzada & others v/s Province of Sindh and others]

Law: Constitution of Pakistan, 1973

Section: 25, 27

Law: Code Of Civil Procedure, 1908.

Section: 0

Summary:
Employees of the Sindh Irrigation and Drainage Authority (SIDA), who were previously working under the Water Sector Improvement Project (WSIP) and were regularized under the Sindh (Regularization of Adhoc and Contract Employees) Act, 2013, filed a petition seeking full benefits equal to Sindh Government civil servants under the Sindh Civil Servants Act, 1973. They sought pension, gratuity, GP Fund, promotions, and seniority benefits from their initial hiring date.

The Court held that while these employees were regularized, they were not civil servants, as SIDA employees fall under a separate authority framework. The Court directed the Chief Secretary Sindh to convene a meeting with SIDA and the Irrigation Department within three months to address and resolve the issue on the administrative side.
