Summary of the Judgment
Case Background:
Ms. Farzana (Petitioner No.2) alleged that her father (Respondent No.8) intended to force her into marriage. She left home and married Mr. Hakim Ali (Petitioner No.1) of her own free will. In retaliation, her father lodged FIR No. 54/2008 under Sections 365-B, 344, 346/34 PPC, accusing Hakim Ali and his relatives of kidnapping her.
The petitioners sought protection, recognition of their marriage, and quashment of the FIR, arguing it was false and filed maliciously.
âš–ï¸ Respondent’s Argument:
Claimed Ms. Farzana was a minor, incapable of consent.
