Date of hearing and Order: 27.05.2025 M/s. Muhammad Aibak Ali Shah and Nadir Rajput advocate for the petitioner. Mr. Ali Safdar Depar Assistant Advocate General along with Dr. Liaquat Ali Abro and Nadeem Qurshi Law officers, Law department, Government of Sindh
(Khurram Faizan v/s Province of Sindh & others)
Law: Constitution of Pakistan, 1973
Section: 199,25,38
Summary:
The petitioner, a BPS-15 Stenographer at the District & Sessions Court, Karachi-West, sought judicial declarations regarding advance increments for an LL.B. degree and a special allowance for an LL.M. degree.
He relied on a Sindh High Court notification dated January 22, 1999, which granted two advance increments to employees of the subordinate judiciary holding an LL.B. degree, and also sought an LL.M. allowance of Rs. 5,000 per month, claiming parity with judicial officers and other provincial departments.
The respondents (Finance Department & Government of Sindh) opposed the petition, asserting that advance increments were discontinued in 2001 and that the LL.M. allowance applied only to “officers†(BPS-17 and above), not to ministerial staff like stenographers.
