🧾 Summary:
The petitioners, who were Sub-Inspectors, argued that their promotion to Inspectors (BPS-16) should be effective from August 2015, when 25 vacancies became available. However, due to departmental disputes and stay orders, the Departmental Promotion Committee (DPC) was delayed until 10 October 2017.
The Supreme Court held that the delay was caused by the department’s own fault (due to irregularities in the seniority list) and not by the petitioners. Therefore, the petitioners were entitled to promotion retrospectively from August 2015, when the vacancies arose.
The Court emphasized timely promotion, fair treatment, and legitimate expectation under Articles 4, 25, and 27 of the Constitution of Pakistan.
