Summary:
The petitioners challenged orders refusing full amendment of their plaint under Order VI Rule 17 CPC. The trial court allowed amendment only to the extent of receipts already on record but refused introduction of new foundational facts (dates, witnesses, installments). The appellate court upheld this. The High Court held that the amendments sought were not mere clarifications but an afterthought intended to fill lacunae after trial and appeal. Finding no illegality in the lower courts’ orders, the writ petition was dismissed in limine.
