Government of Punjab, etc.

Law: Provincial Employees Social Security Ordinance, 1965

Section: 2(8)(f), 20, 71

             Summary ;

Issue:
Several constitutional petitions challenged the vires of Notifications dated 19.07.2022, 17.10.2023, and 20.09.2024 that directed computation of Social Security contributions on the basis of the revised minimum wages fixed under the Punjab Minimum Wages Act, 2019. The central question:
Is the benchmark wage for contribution under the Provincial Employees’ Social Security Ordinance, 1965 determined by minimum wages notifications under other laws (Minimum Wages Act, 2019), or exclusively under Section 71 of the Ordinance?

Petitioners’ Arguments

Contributions can only be computed on the basis of wages notified under Section 71 of the Ordinance, not minimum wages fixed under other laws.
