Summary of Order

The petitioner, a former employee of Pakistan Industrial Development Corporation (PIDC) and related entities, challenged the denial of his claims for back benefits, salaries, and arrears spanning from 1986 to 2005. Despite earlier reinstatement by the Federal Service Tribunal (FST) and partial relief by the Supreme Court, his claims for back benefits prior to October 2000 were disallowed due to lack of evidence of non-gainful employment during that period.

The petitioner argued that the respondents misinterpreted court judgments and that he should receive full back benefits, citing relevant case law and service rules. Respondents contended the petition was barred by res judicata and abuse of process, emphasizing prior final decisions and compliance with court orders.

The Court found the petition to be a re-litigation of settled matters, upheld the Supreme Court’s earlier ruling disallowing back benefits for the disputed period, and dismissed the petition.
