Section: 199

Summary of Judgment

The Petitioner, a welfare association, sought restoration of its registration (No. 0485 of 1986), which was cancelled without prior notice. The Petitioner also sought cancellation of registration No. 037 of 2021 granted to Respondent No.3, an association allegedly formed by former members of the Petitioner.

The Petitioner learned of the cancellation through a letter dated 9.11.2021 and applied for restoration, which was declined. The Petitioner delayed approaching the Court because it was pursuing the matter before the Provincial Ombudsman, who issued a decision on 6.5.2025.

The Ombudsman found that the Petitioner violated its byelaws, especially by failing to submit the annual list of office bearers for 17 years, rendering the association dormant and justifying cancellation. Allegations against the new office bearers involved disputed facts requiring civil court adjudication.
