Section: 3
Summary of Judgment and Core Points
The petitioners, employed as Naib Qasid and Driver in the Board of Revenue Sindh’s LARMIS project, sought regularization of their services and protection from termination prior to such regularization. They were initially appointed through a competitive process on a contract basis in 2009, with subsequent extensions and changes in roles. The government argued that their later roles were on a contingent/temporary basis, making them ineligible for regularization under the Sindh Regularization of Adhoc and Contract Employees Act, 2013.
The Court found that the petitioners were originally appointed on contract through a competitive process for regular posts, and that their colleagues in similar positions had already been regularized. The Court referenced several Supreme Court decisions supporting regularization in such circumstances and noted that the project had transitioned to regular budget posts. It directed that the petitioners’ cases be processed for regularization in line with previous court orders, which were also upheld by the Supreme Court.
