Law: Punjab Protection Against Harassment of Women at The Workplace (Amendment) Act, 2012
Section: 3, 4(4), 8, 10
SUMMARY:Workplace Harassment
This constitutional petition challenged the orders of the Ombudsperson (dated 17.04.2023) and Governor Punjab (dated 25.07.2024), which imposed the major penalty of removal from service on the petitioner (a Naib Qasid at FDA) for sexual harassment of a female coworker under the Protection Against Harassment of Women at the Workplace Act, 2010. The Court found that sufficient evidence (including witness statements, CCTV footage, and co-accused’s confession) proved a pattern of offensive conduct. The Court held that due process was followed and dismissed the petition, citing lack of jurisdiction to review such matters where statutory remedies have been exhausted.
