Summary of Judgment
This case involves Muhammad Ikram, Muhammad Kamran, and Muhammad Rizwan, who were convicted by the Anti-Terrorism Court, Rawalpindi, for the murders of Ghulam Dastagir and Ghulam Habib. The incident occurred near the court premises in Talagang, District Chakwal, and was motivated by longstanding enmity and revenge between the parties. The petitioners were initially sentenced to death under Section 302(b) of the Pakistan Penal Code (PPC) and Section 7(a) of the Anti-Terrorism Act (ATA), along with fines and compensation to the legal heirs of the deceased.
Upon appeal, the High Court upheld the convictions under PPC but set aside the convictions under the ATA. The Supreme Court, recognizing the presence of mitigating circumstances such as personal vendetta and lack of premeditation, converted the death sentences to life imprisonment on two counts, to run concurrently, and allowed the benefit of Section 382-B of the Criminal Procedure Code (Cr.P.C.), which allows for the period already spent in custody to be considered as part of the sentence1.
