Section:

Summary;

Petitioner’s Claim: The petitioner sought a writ to be declared as the second position holder in the HSSC Examination 2013, sharing the position with respondent No.3, as both secured 1010 marks.

Petitioner’s Argument: She appeared in the exam, obtained 475 marks initially, and then improved her marks by re-appearing in two subjects (English and Urdu) within two years, increasing her total to 1010 marks. She claimed this was allowed under the Board’s rules and thus she deserved to share the second position.

Respondent No.1 (Board) Argument: The petitioner was a repeater in two subjects, and according to the Board’s policy, repeaters are not entitled to ranking among position holders.
