SUMMARY Medical Re-examination

If during the medical examination, crushed cricoid cartilage with exposed hypopharynx of the injured has been observed/noted by the Medical Officer in the MLC then it was necessary to have final evaluation of the same after obtaining opinion from ENT Specialist and if the same has not been done then it amounts to omission as well as violation of the settled principles of medical science/jurisprudence which necessitates constitution of Medical Board for doing the needful in this regard.

The petitioner, Muhammad Jehan Zeb Noon, challenged the order dated 24.07.2024 of the Magistrate Section-30, Pindi Bhattian, which rejected his application for constituting a District Standing Medical Board regarding the injuries of his brother Muhammad Anas, who was the injured party in FIR No.733/2023, registered on 04.09.2023.
