Section: VI Rule 15
Summary:Election Petition
The petition challenging the election result in NA-135, Okara-1 under Sections 139 and 142 of the Elections Act, 2017 was dismissed. The petitioner argued the tribunal loses power to reject the petition after notices are issued and distinguished between “rejection†and “dismissal.†The tribunal held it retains power to summarily reject a petition for non-compliance even after notices, citing Sections 145(1), 154, and 155 of the Act. The tribunal found the verification of the petition defective under Order VI Rule 15 CPC and Section 144(4) of the Act, rendering the petition non-compliant and thus summarily rejected it under Section 145(1).
