Case Summary:Partial Cancellation
The petitioner challenged the order dated 25.04.2024 passed by the Special Judge, Anti-Corruption Court, Dera Ghazi Khan, which partially accepted the cancellation report submitted by the Anti-Corruption Establishment (ACE) regarding an FIR (No. 11/2020) about fraud and forgery in inherited property matters. The High Court held that partial acceptance of cancellation is not legally permissible. The Special Judge was directed to re-decide the case in accordance with law, as private individuals cannot be tried without framing charges against public servants under the Anti-Corruption laws.
