 SUMMARY;  Service/Fixation of pay

This Civil Petition challenges the Federal Service Tribunal's judgment dated 27.07.2023, which allowed the respondent's service appeal to fix his pay with benefits based on an earlier Tribunal judgment from 04.02.2019. The respondent claimed that the President of Pakistan had sanctioned a 15% pay increase effective 01.07.2007, but the Finance Division's implementation via the 2007 Basic Pay Scales did not fully reflect this increase due to the point-to-point fixation formula and rounding practices. The respondent sought pay fixation consistent with the President’s order and prior Tribunal decisions.

The Deputy Attorney General (DAG) argued that the pay increase was correctly applied according to the Office Memorandum and international rounding standards, that the respondent’s appeal was time-barred, and that the Tribunal lacked authority to interfere with government pay policy unless it was arbitrary or illegal. The DAG also highlighted the respondent’s undertaking to refund any excess amount if earlier favorable judgments were overturned, which this Court had done by setting aside the 2019 Tribunal judgment on 28.04.2022, recognizing rounding off as a legitimate accounting practice.
