Summary:

The petitioner, a government employee initially appointed as a Chowkidar in BPS-1 in 1993 and later made a Driver in BPS-5 in 1996, sought upgradation to BPS-7 and associated benefits based on long service and government time-scale policies. He claimed similar upgradations had been granted in other departments and referenced specific government notifications and precedents. The Court held that time-scale and upgradation are policy matters distinct from promotions and are not automatic rights. The petitioner failed to prove that his move to the Driver post was a promotion or that he met criteria for further promotion or upgradation. The Court found no legal basis to grant his request and dismissed the petition in limine.
