(Punjab Beverages Company Private Ltd v Federation of Pakistan & others)

Law: Pakistan Penal Code, 1860

Section: 489-F, 420, 34

Summary:

Punjab Beverages Company Pvt. Ltd. filed a petition stating that its CEO and MD were declared proclaimed offenders in Karachi in connection with two FIRs (749/2019 & 751/2019 under Sections 489-F, 420, 34 PPC) related to dishonored cheques, despite not residing or having any office in Karachi. They claimed no knowledge of the FIRs for four years and denied signing the cheques, terming them "security cheques." The petitioners feared arrest in undisclosed FIRs and alleged misuse of legal process by the complainant. The Court had earlier ordered a report on any criminal cases in Sindh. Reports from all DIGs, except East Karachi, confirmed no other FIRs existed. The two known FIRs were confirmed by DIG East. The Court disposed of the petition, noting the objective had been met and ordered no harassment to either party, with pending cases to be decided by competent courts.
