Before: Mr. Justice Muhammad Karim Khan Agha Mr. Justice Adnan-ul-Karim Memon Date of hearing and order: 24.1.2025 Mr. Ahmed Ali Hussain advocate for the petitioner
(Zulfiqar Ali Kariro v province of Sindh & others)
Law: Constitution of Pakistan, 1973
Section: 212(2) ,199
Summary of Order Sheet:
Petitioner Zulfiqar Ali Kariro, a Sub-Registrar in the Revenue Department, challenged a show cause notice and disciplinary proceedings initiated against him under the Sindh Civil Servants (Efficiency & Discipline) Rules, 1973, claiming they were illegal, malafide, and violated his service rights. He alleged lack of fair hearing, and that the charges (fraud, forgery, and tampering with property records) were baseless and related to a period before his posting.
The Court, however, emphasized that disciplinary matters relating to civil servants fall under service matters, which are exclusively within the jurisdiction of the Sindh Service Tribunal as per Article 212(2) of the Constitution and relevant case law including Ali Azhar Khan Baloch v. Province of Sindh (2015 SCMR 456).
