Adnan-ul-Karim Memon, J
Date of hearing and order: 07.04.2025 Mr. Ahsan Ali Siyal advocate for the petitioner Mr. Ghulam Shabbir Babar advocate. Mr. Ali Safdar Depar AAG Mr. Qamaruddin Nohri, DPG, along with SHO Muhammad Younus, SIP Wali Muhammad Shar, and SIP Tariq Jatt of PS Bin Qasim, Karachi
Respondent No.7 present in person.
(Saifullah Jamali v Province of Sindh & others)
Law: Code Of Civil Procedure, 1908.
Section: 7 rule 11
Summary of the Court Order:
The petitioner claimed he had lawfully purchased and taken possession of a plot in Data Nagar, Karachi, but was being harassed and threatened by private individuals who, with the help of police (particularly Respondent No.5), were attempting to forcibly dispossess him. The petitioner also alleged police misconduct and threats of false FIRs.
The court was informed that a related FIR (No. 386/2023) had been filed and challaned, and a civil suit by the petitioner had already been rejected. Additionally, a Sessions Court had earlier ruled that the petitioner lacked a prima facie legal right to the property. Despite this, the Assistant Advocate General stated that the police would remain neutral and take legal action only if a cognizable offence occurs.
