Summary:
| Under clause IX of the Recruitment Policy, 2011, where a joining has not taken place or some candidates have left after joining, only then the next candidate on the merit list/waiting list can be issued letter of agreement. However, if a candidate after joining is dismissed from service under relevant law, the next candidate on the merit list cannot be appointed but the said seat has to be filled through fresh recruitment process. |
This constitutional petition challenges the orders dated 19.09.2012 and 31.12.2012, which denied the petitioner the appointment for the post of SSE (Engineer) after a candidate from the initial selection list, Usman Farid Chishti, was terminated under the Punjab Employees Efficiency, Discipline and Accountability Act (PEEDA Act).
