SUMMARY
This writ petition challenges the decisions dated 26.11.2021 and 23.02.2022 by the Civil Court and Additional District Judge, Khanewal. The case originates from a suit filed by the deceased Arif Ali, represented by his legal heirs, on 06.09.2016, which was later amended on 05.04.2017 after the death of a defendant.
The respondents sought an amendment under Order VI Rule 17 of the Code of Civil Procedure, 1908, to insert the word “declaration†in the heading and challenge a 1995 order by the District Collector. The Civil Court allowed this on 26.11.2021, and a revision petition against it was dismissed on 23.02.2022. The petitioner argues that this amendment changes the nature of the suit and was filed after the evidence stage to cover gaps.
