Summary of the Order
The petitioner, Miraj Zubair, filed a habeas corpus petition for the recovery of her husband, Arif Ali, alleging his illegal detention by the Station House Officer (SHO) of P.S. Renala City, Okara.
On 07.01.2025, the Court appointed a Bailiff, who confirmed Arif Ali's detention at the police station. Arif Ali stated that he was arrested from his hotel in Sahiwal on 19.12.2024 and had not been presented before any court. The police formally recorded his arrest only on 07.01.2025. The petitioner also claimed she was arrested alongside her husband but released on 24.12.2024.
The SHO presented Arif Ali in court, claiming his arrest in connection with FIR No. 1608/2024 (u/s 392 PPC) for the theft of a motorcycle and other items. However, the FIR was initially against unknown persons, and no solid evidence was provided to prove Arif Ali's involvement. The Bailiff found no supplementary statement or proper recovery records linking him to the case.
