Summary of the Order:
The fiscal matter has been pending since 2022, with an interim order in place from the beginning.
Despite the ongoing interim order, the learned counsel for the Department (Commissioner Inland Revenue, Audit-I, Large Taxpayers Office, Karachi) was absent, and an adjournment was sought on their behalf.
The court adjourned the matter and ordered the interim order to continue until the next date of hearing.
The Federation and FBR have repeatedly raised concerns about the pendency of fiscal matters in the High Courts. However, the court expressed that this continuous grievance reflects the department's disinterest in proceeding with fiscal matters, even though interim orders are operating to their detriment.
The office has been instructed to directly communicate a copy of the order to the Attorney General for Pakistan, the Secretary Revenue Division, and the Chairman FBR in Islamabad.
ORDER
This fiscal matter is pending since 2022. Despite operation of interim order from onset, learned counsel for the Department (Commissioner Inland Revenue, Audit-I, Large Taxpayers Office, PRC Towers, 32-A, Lalazar Drive,
M.T. Khan Road, Karachi is not present and brief being held and adjournment sought on his behalf.
Adjourned. Interim order passed earlier to continue till the next date of hearing.
The Federation and the FBR has constantly agitated the issue of pendency of fiscal matters before the respective High Courts. While such grievance is repeated time and time again, however, the order passed herein, prima facie, demonstrates the disinterest of the department itself in proceeding with fiscal matters before this court; irrespective of interim orders operating to their detriment.
