P. C. And was originally filed in the Court of the Civil Judge and First Class Magistrate, Rohri on 28-7-1972. The case was thereafter, transferred to the Court of Sub-Divisional Magistrate, Saddar, Sukkur on 17-8-1972. An application was made in the High Court for transfer of this case from the Court of the Sub Divisional Magistrate and the said application was dismissed. Applicant Muhammad Nawaz thereafter filed an appeal before the Supreme Court of Pakistan and in that appeal it was ordered that this case may be tried on the original side of the High Court. By au order dated 20-10-1973 my Lord the Chief Justice directed this case to be placed before me for trial and I have proceeded with the trial/enquiry into the case. 2. The brief facts of the case are that Retired Air-Marshal M. Asghar Khan owns 242 acres of agricultural land in Deh Jhanghro and Deh Ranhanwar in Tehsil Rohri of the District of Sukkur.
