Constitution of Pakistan, 1973-- ----Art. 199--Punjab Civil Servants (Appointments & Conditions of Services) Rules, 1974, R. 17-A--Death during service--Appointment of his daughter on contract basis--Expiry of contract period--Filling of petition regarding--Entitlement of petitioner for fresh appointment--Direction to--It is very astonishing that while deciding matter, Executive District Officer (Education) has declared petitioner entitled for appointment under Rule 17-A ibid but on contract basis--Petitioner is entitled for appointment under Rule 17-A of Punjab Civil Servants (Appointments & Conditions of Services), Rules, 1974 on regular basis. Consequently, Respondent No. 2 is directed to ensure appointment of petitioner on regular basis under Rule 17-A within one month under intimation to Deputy Registrar (Judicial) of this Court--Petition was accepted. THIS ORDER PASSED BY: SHUJAAT ALI KHAN, JUSTICE---.--- Unnecessary details apart, father of the present petitioner died while serving as Class-IV employee in the Government Higher Secondary School (Girls), Satellite Town, Bahawalpur whereafter, the petitioner was appointed under Rule 17-A of the Punjab Civil Servants (Appointment & Conditions of Services) Rules, 1974 as Water Carrier in the said school on contract basis for three years vide appointment order dated 10.03.2010. The Principal, Govt. Higher Secondary School (Girls), Satellite Town, Bahawalpur (Respondent No. 4) dispensed with services of the present petitioner through order dated 16.03.2013 on the ground that her period contract had already been expired. Thereafter, the petitioner filed Writ Petition No. 9020 of 2014/BWP before this Court whereupon the matter was referred to the erstwhile Executive District Officer (Education) Bahawalpur. Pursuant to order dated 03.11.2016, passed by this Court in aforementioned writ petition, Respondent No. 2 passed order dated 21.12.2016 whereby he held the petitioner entitled for appointment afresh under Rule 17-A ibid on contract basis.
