ORDER Through this miscellaneous application, the applicant has requested for grant of stay against the recovery of impugned tax demand. 2. Learned counsel for the applicant submits that the matter is pending before this Tribunal for adjudication. Learned AR further submits that concerned relief was granted by the Commissioner (Appeals) for which no revised demand notice after giving appeal effect has been issued by the Department. Learned AR also submits that the Department is pressing hard for the recovery and the inspectors of the concerned zone time and again come to the business premises and harass the taxpayer for the recovery of disputed demand. Accordingly, he prayed that the stay may kindly be granted till the disposal of appeal and alternatively he requested for out of turn fixation of appeal. 4.
