Constitution of Pakistan, 1973-- ----Art. 199--Constitutional Petition--Allegation of unfair means--Identification marks in papers--Violation of instructions--Disqualified by disciplinary committee--Appeal--Rejected--Challenge to--Respondents have already declared petitioners as passed in said subject, therefore, their disqualification period for one year will be considered which has already lapsed during which they did not appear in any examination conducted by universities--Purpose of putting identification marks' was not achieved when cases of UMC was made out prior to checking--However, normally after making UMC cases papers were required to be checked which could have bearing upon quantum of punishment; i.e. whether disqualified for one year or for two years from appearing in exams--Petitions are disposed of directing respondent to issue normal examination fee vouchers to petitioners within seven days from today by Controller Examinations. THIS ORDER PASSED BY: ALI BAQAR NAJAFI, JUSTICE---.--- This order shall dispose of the instant writ petition as well as W.P. No. 11258-2017 titled "Allah Rakha vs. B.Z.U. etc." as common questions of law and facts are involved in both these petitions. 2. Through these constitutional petitions, the petitioners have challenged the order dated 15.07.2017 & 17.07.2017 as well as 27.07.2017 whereby petitioners of both the writ petitions were found guilty of unfair means cases and were disqualified by the Disciplinary Committee for one year two chances from passing 1st Annual Examination 2016 on the allegation that they have used different identification marks in the papers mentioned in their respective answer sheets. 3. Brief facts giving rise to the filing of these writ petitions are that all petitioners got admission in LL.B. in Muhammadan Law College Sahiwal which is a duly affiliated with Bahauddin Zakariya University (B.Z.U.), Multan and appeared in the 1st Annual Examination. 2016.
